Cannabis Clubs

Cannabis clubs, often called grow clubs or social clubs, operate in a legal grey zone in South Africa. These member-based collectives claim to grow and share cannabis privately, often avoiding direct sales by using “donations” or membership fees. However, the Cannabis for Private Purposes Act does not legitimise this model. Cultivating or distributing cannabis on behalf of others - even without payment - is considered illegal. Despite some clubs believing they are protected under constitutional rights, their legal standing remains uncertain, and enforcement actions continue.

Medical Exemption

Medical cannabis is regulated under the Medicines and Related Substances Act, with oversight provided by the South African Health Products Regulatory Authority (SAHPRA). Products containing THC are classified as Schedule 6 medicines, meaning they can only be prescribed by a licensed medical practitioner and dispensed by authorised healthcare providers. Patients can legally access these treatments through SAHPRA’s Section 21 exemption process, which allows doctors to apply for permission to use unregistered cannabis-based medicines on behalf of their patients. These products must meet Good Manufacturing Practice (GMP) standards, ensuring consistent quality, safety, and efficacy.
